A challenging international debt recovery matter

We were instructed by a client in relation to a substantial outstanding debt involving an individual based outside the United Kingdom.

The matter presented a number of challenges, including difficulties establishing reliable contact with the debtor and obtaining a satisfactory resolution to the outstanding balance.

Following a detailed review of the information and documentation provided by our client, we developed a recovery strategy appropriate to the circumstances of the case.

Our approach included establishing the relevant background, making contact with the debtor, communicating the client’s position and pursuing the matter through the appropriate channels.

Where a debtor disputes a debt or raises issues concerning the underlying transaction, it is important that the position is assessed carefully and that any proposed recovery action is supported by appropriate evidence.

In this case, our involvement enabled the client to move the matter forward and provided a structured approach to pursuing recovery.

What this case demonstrates

International debt recovery can present additional challenges compared with domestic recovery, particularly where:

• the debtor is located outside the UK;
• communication is difficult or inconsistent;
• there is a dispute concerning the underlying transaction;
• information supplied by the debtor needs to be assessed carefully; or
• further legal or enforcement action may need to be considered.

Our role is to assess each matter individually and discuss with our client the most appropriate recovery options.
